On December 22, 2021, the New York Governor Kathy Hochul signed Senate Bill 1780C, and finally, the law which allowed Remote Online Notary service in New York came into effect from June 20, 2022.
Remote Ink Notarization, which is a combination of ink notarization and online technology, is not allowed since January 2023. Initially, there was a temporary law related to both remote ink and online notarization. But now, there is a permanent law related to electronic notarization.
No, it is not important for the signer to be present in NYS for electronic notarization. For the notary, it is compulsory that they are physically in NY. The flexibility to be present anywhere in the world is only for the signer.
